Murphy Sanchez, PLLC has a national practice that has been built around the needs of a diverse clientele for the purpose of not only driving recoveries but to also participate when needed in the discussions about process.  We have designed our subrogation department with the primary goal of serving our clients within their framework, not our own.  We have intentionally rejected requirements that many carriers see at other providers  that would  limit our ability to service our clients in a way they expect and deserve.

In addition to working with numerous insurance carriers, we team with many self insureds, third-party administrators, captives,  and subrogation services companies to facilitate a streamlined and efficient process with a focus on maximizing recoveries and minimizing delays.  We have worked with many clients in assisting them in developing  programs, processes, and policies to assist them in their recovery processes.

Property Claims

We consistently handle property claims ranging from multi-million dollar losses to losses of just a few thousand dollars.  Our subrogation attorneys are responsible for increasing our clients’ recoveries year over year.  Whether we are dealing with builders risk coverage, property coverage, or other policies protecting real property, we have the experience to navigate the situation at hand.

 

Automobile/Trucking Claims

Our attorneys handle all manner of automobile and trucking claims throughout the United States.  Efficient handling is the hallmark of our practice, and it is never more important than in the prosecution of these claims as we address cargo claims, MCS-90 recoveries, and business income losses for large fleet owners.

 

Workers Compensation Claims

Our group of attorneys have been serving as the outsourced workers compensation subrogation team for many carriers for several years.  We have worked diligently with our clients to implement a streamlined standard of practice management that maximizes recoveries while managing costs and risks.  We have trained numerous subrogation departments and adjusters on identifying losses, facilitating recoveries without counsel when possible, and how to negotiate settlements aggressively and creatively.  We are focused on the clients’ needs which do not always manifest in the largest recovery but oftentimes require a nuanced approach to global resolutions in collaboration with the workers compensation defense team.

 

Aviation Claims

We handle property and workers compensation claims associated with policies of insurance covering aircraft, aircraft services companies, and airport vendors.  Over the last decade we have grown our practice to handle multi-million dollar property claims, death claims, and claims outside the United States.  With a strong understanding of the industry’s complex contractual, regulatory, and technical landscape, we are equipped to handle aviation-related recoveries with precision and effectiveness.

 

Extra-Contractual Claims

We are often called upon to consult on what is known as the “pay and chase” case.  There are times when it is in the insured’s best interest to resolve a matter and cap exposure and then initiate a separate claim for recovery.  Whether it’s a property damage or personal injury matter, we will oftentimes team up with defense counsel and coordinate an effective resolution while preserving our rights to move forward and then prosecute the recovery of that file for the best result possible.

With over three decades of experience, Murphy Sanchez actively and aggressively represents its clients in all stages of the Workers’ Compensation process.  Our attorneys can provide services ranging from pre-suit legal advice, in-house training for claims reduction, risk management along with representation once claims are filed in court.  Murphy Sanchez’s experience with large companies positions us to tackle all types of claims from occupational, repetitive work claims and traumatic events. 

The handling of Product Liability claims is very often a team approach between counsel and client with an eye toward a systematic plan of action to protect the client and its product.  We represent a wide range of clients and their products including industrial machinery, consumer goods, pharmaceuticals, and fire protection components. Attorneys in our Product Liability Practice Group have served as National Coordinating Counsel in the Latex Glove MDL on behalf of a large manufacturer. Murphy Sanchez carefully evaluates each claim throughout the litigation ensuring that the client is always informed of all potential outcomes, allowing for a collaborative decision making process.

Premises liability is at the heart of Murphy Sanchez’s practice.  Every one of our members and associates has trained in premises liability and defended premises liability cases for the greater part of their careers.  Each of us handles premises liability cases for both insured and self-insured clients.  We are well-versed in the laws of our jurisdiction pertaining to structural defects, transient defects, statutory liability and contractor liability.  Our evaluation of a premises case also extends beyond our client’s potential liability to the plaintiff and will touch on areas such as lease interpretation, responsible contractors and the potential for indemnity and recovery on behalf of our client from another tortfeasor.

Our attorneys are also experienced in the evaluation of the damages aspects of these cases, whether they be personal injury or property damage.  From the most minor of injuries up to a total building collapse, our team has the knowledge and experience to assess the claim and assist the client in evaluating and defending both pre-suit matters and lawsuits, through trial.

Murphy Sanchez, PLLC’s Fire and Life Safety Group includes highly-experienced and knowledgeable attorneys handling litigation and consulting with clients throughout the United States and Canada.  With more than a combined half-century of experience in the Fire and Life Safety field, we handle all manner of claims involving property damage and personal injury and work with Fire Protection companies and carriers to design and implement risk management processes to limit liability and best position our clients when events do occur. 

Our attorneys have developed a deep understanding of fire protection technologies and the standards that apply to their design, installation, inspection, and maintenance.  They are experienced in scene investigations and are oftentimes called at the time of the occurrence to inspect and investigate a loss in conjunction with a Fire Protection Engineer and/or Origin and Cause expert.  We have been involved in hundreds of claims beginning on the date of loss in order to protect our client’s interests and, in a significant number, have leveraged our knowledge and experience to ultimately avoid their inclusion in subsequent litigation.  With many claims and suits arising out events and conditions outside our client’s control or scope of work, having a seat at the table from the outset to educate others is paramount to a proper defense.  

In addition to defending our clients when there has been a loss, our attorneys consult with clients on how to best protect themselves against liability in the event of a loss and general risk management.  This includes review and/or preparation of regularly used forms, reports, documents and contracts to assure that those materials include language and terms and conditions that will limit their exposure and risk in the event of a failure or loss.  George D. Bogris, Esquire, is a member of the National Fire Sprinkler Association and American Fire Sprinkler Association who has been an invited speaker at industry conferences across the country at industry, giving seminars on a variety of topics intended to help Fire Protection companies better protect themselves against claims and liability.  Sandra T. Carson, Esquire, and Jeffrey C. Sotland, Esquire, have also spoken to clients and carriers on the topics addressing the industry and the importance of following best practices.

Murphy Sanchez maintains a maritime casualty practice, including disputes involving charter parties, tug & tow, collision and allision, and salvage. Our attorneys are experienced in defending maritime personal injury and death actions, including actions arising under the Jones Act, Section 905 (b) of the Longshore & Harborworkers Compensation Act, Death on the High Seas Act, General Maritime Law and recreational marine and marina accidents.
